Right to privacy is fundamental right, under art 21( right to personal life and liberty) given by the Indian constitution, but it is not mentioned in the constitution, it was represented by Judiciary in no of cases, filed when an individuals privacy was breached by the govts and private firms. Though it is fundamental right but it is not absolute right, it has restriction as well. But what brings us to the raise of this privacy issue. Before that lets have a picture about today’s digital world.
with the advancement of technology, decrease of telecom network charges, development of new social media plat forms has grown with rapid pace since the decade. social media platforms like twitter, Facebook, what’s app, Instagram grown, but not only this, there is growth of fake news, fake threats, terrorist activities and many illegal activities as well on these social media platforms. Whatsapp as a feature of creating groups, twitter as feature of reposting any post, Facebook as a feature of following pages and events. when a fake message or a fake post is posted on these groups, then it is creating clashes in the society and in few incidents it is leading to growth of communal hatred as well.
what is real problem here, a conflict for same interest on both sides. lets see examples of cases *whatsapp interest on protecting individual privacy (and) govt interest on protecting national security. *twitters interest on protecting individual freedom of expression (and) govt interest on national security. *Facebook interest on protecting individual data while collaborating with whatsapp (and) govt interest on securing citizens data on a local server. * MIND MAP:-it is created by data available with firms. with analysis of data, they can find about a regions or a group or a communities interest, like housing, clothing, type of food they eat, like many factors can be known by a mind map.
Facebook as company receive huge amount of data everyday, but issue a raised where it was being stored, when it was stored on a foreign server it helps those firms create a mind map of the country, which lead to exploitation of Indian citizen by foreign firms. Facebook wants to sell data of its users to whatsapp company, where firms may demand citizens mandatory registration with both firms to use any one. it is heard in SC under KARMANYA SINGH SARAN VS UNION OF INDIA
Being biased is a dangerous thing, not only the private firms will violate our privacy but the government can also breach our policy. lets imagine , if govt has control on our social media accounts, it will prevent our freedom of expression, when the freedom of speech & expression of journalist or intellectuals its will lead to suppress our democracy. when an individuals privacy is taken away it also takes our freedom, and govt could monitor activities of individuals.
Better there be a middle path created by not breaching privacy and maintaining national security as well. it is in the hands of Judiciary, lets hope Judiciary will protect its citizens.
